What Does a Fire Risk Assessment Involve?

A fire risk assessment is a systematic evaluation of your premises carried out under the Regulatory Reform (Fire Safety) Order 2005. It must cover five key areas.

Identify Fire Hazards

We locate potential sources of ignition, sources of fuel, and sources of oxygen throughout your premises, including electrical equipment, heating systems, flammable materials, and natural ventilation.

Identify People at Risk

We consider everyone present — employees, visitors, contractors, customers, and anyone especially vulnerable, including those with disabilities or mobility impairments. For care homes, this includes individual PEEPs.

Evaluate & Reduce Risks

The assessor evaluates the level of risk and recommends measures to eliminate or reduce it, reviewing fire detection, fire extinguishers, fire doors and compartmentation, means of escape, emergency lighting, and signage.

Record Findings

Since October 2023, every fire risk assessment must be recorded in writing. You receive a comprehensive PAS 79-1:2020 report with significant findings and a prioritised action plan with clear timescales.

Review & Update

Your assessment must be kept under regular review and updated when there are significant changes. Annual reviews are recommended as a minimum, with more frequent reviews for higher-risk premises.

Why Do You Need a Fire Risk Assessment?

A fire risk assessment is a legal requirement for virtually every non-domestic premises in England and Wales. The Regulatory Reform (Fire Safety) Order 2005 places the responsibility squarely on the “responsible person” — typically the employer, building owner, landlord, or managing agent — to ensure a suitable and sufficient fire risk assessment is carried out and kept up to date.

This applies to offices, shops, restaurants, pubs, hotels, B&Bs, warehouses, factories, care homes, schools, churches, blocks of flats (communal areas), HMOs, and any other building where people work, visit, or reside that is not a single private dwelling.

The legal consequences of non-compliance are severe. Humberside Fire and Rescue Service has the power to carry out unannounced inspections at any time. If they find no fire risk assessment, or one that is inadequate, they can issue an enforcement notice requiring corrective action, a prohibition notice closing your premises immediately if there is a serious risk to life, or prosecute the responsible person. Penalties include unlimited fines and up to two years’ imprisonment. Directors, partners, and managing agents can be held personally liable.

Beyond the legal obligation, failing to maintain a valid fire risk assessment can invalidate your building insurance. In the event of a fire, your insurer may refuse to pay out if you cannot demonstrate a current, compliant fire risk assessment was in place.

The Fire Safety Act 2021 and the Building Safety Act 2022 have further strengthened fire safety requirements, particularly for residential buildings. The Fire Safety (England) Regulations 2022 extended the duties of responsible persons in multi-occupied residential buildings, including requirements to share fire safety information with residents and carry out regular checks of fire doors in communal areas.

Frequently Asked Questions

Is a fire risk assessment a legal requirement?
Yes. Under the Regulatory Reform (Fire Safety) Order 2005, every non-domestic premises in England and Wales must have a suitable and sufficient fire risk assessment. The responsible person — typically the employer, building owner, landlord, or managing agent — must ensure this is carried out and kept up to date. Since October 2023, all fire risk assessments must be recorded in writing regardless of the number of employees. Failure to comply can result in enforcement action from Humberside Fire and Rescue Service, unlimited fines, and up to two years’ imprisonment.
How often should a fire risk assessment be done?
There is no single fixed legal timeframe, but best practice is to review your fire risk assessment at least annually and carry out a full new assessment every 3 to 5 years. You must also review it whenever there is a significant change to your premises — such as alterations to the layout, a change of use, building works, a fire incident, or a change in the people using the building. For higher-risk premises such as care homes, HMOs, and sleeping risk premises, annual full reviews are strongly recommended.
Who is the responsible person for fire safety?
The responsible person is defined by the Fire Safety Order as the employer, or in relation to any premises not connected with work, the person who has control of the premises. In practice this is usually the business owner, landlord, managing agent, or facilities manager. In a building with multiple occupiers, there may be more than one responsible person. The responsible person can appoint a competent person — such as a qualified fire risk assessor — to carry out the assessment on their behalf, but the legal responsibility remains with them personally.
Can I do my own fire risk assessment?
Technically yes — the law does not require you to use an external assessor. However, the assessment must be “suitable and sufficient,” and the person carrying it out must be competent. For anything beyond a very simple, low-risk premises, it is strongly recommended to use a qualified professional fire risk assessor with a recognised fire risk assessment qualification and professional indemnity insurance. An inadequate self-assessment could leave you personally liable in the event of a fire.
What happens if I don’t have a fire risk assessment?
Humberside Fire and Rescue Service can inspect your premises at any time without prior notice. If they find no fire risk assessment, or an inadequate one, they can issue an enforcement notice requiring corrective action, a prohibition notice closing your premises immediately, or prosecute the responsible person. Penalties include unlimited fines and up to two years’ imprisonment. You may also invalidate your building insurance.
How long does a fire risk assessment take?
This depends on the size and complexity of the premises. A small office or shop typically takes 1 to 2 hours on-site. A medium-sized commercial premises or HMO might take 2 to 4 hours. Care homes, schools, and industrial premises can take a full day or longer. You will receive your written report with significant findings and a prioritised action plan. The assessor will tell you when to expect it when you book.
